hyperPad Terms of Service

Welcome to hyperPad! These Terms of Service (“Terms”) explain how you may use hyperPad and outline the relationship between you and GamePress, Inc. (“GamePress,” “hyperPad,” “we,” “us,” or “our”).

By using hyperPad, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

1. What these Terms apply to

These Terms apply to all hyperPad services, including:

  • hyperPad (the full creator app)
  • hyperPad Starter (a limited trial version)
  • hyperPad Hub (the standalone community app)
  • Our websites and related services

These Terms govern use and behavior.

Software licensing details are covered separately in the hyperPad Software License Agreement.

2. How hyperPad works

hyperPad (Creator)

  • Used to create and export games and interactive projects
  • Can be used without an account for local creation

hyperPad Starter

  • A limited version intended for learning and evaluation
  • Includes community access but has usage restrictions (see License Agreement)

hyperPad Hub

  • Used to browse, play, and rate community projects
  • No creation, export, or monetization tools

All Hub access (standalone or embedded) uses the same account system and community rules.

3. Age requirements

  • The hyperPad Hub is available only to users 13 years or older
  • Users between 13–17 must have permission from a parent or guardian
  • We do not knowingly allow children under 13 to use Hub features

If you believe a child has used hyperPad improperly, contact us and we’ll address it.

4. Accounts and access

  • An account is optional for the Creator and required for Hub
  • Keep your account information accurate and up to date
  • One account per person — do not share accounts
  • You are responsible for activity on your account

We may suspend or terminate accounts that violate these Terms or pose risk to the community.

5. Community guidelines (keep it respectful)

hyperPad is a creative community. By using the Services, you agree that you will not:

  • Break any applicable law or regulation
  • Harass, threaten, or impersonate other users
  • Upload content that is hateful, violent, pornographic, or invades privacy
  • Upload content you do not have the rights to share
  • Share private information about yourself or others
  • Hack, scrape, or probe the Services
  • Use bots or automated tools against the Services
  • Harm the hyperPad platform, community, or reputation

We may remove content or take action if these rules are violated.

6. Your content

hyperPad allows you to create and share content (“User Content”).

  • You own your content
  • You are responsible for what you upload or share

By posting User Content on hyperPad, you grant us a non-exclusive, royalty-free, worldwide license to host, display, and distribute that content only as needed to operate and promote hyperPad.

We do not take ownership of your projects.

7. Public sharing and the Hub

If you choose to share content publicly in the Hub:

  • Other users can view, play, rate, and comment on it
  • Shared content is subject to moderation
  • You can remove your content at any time, subject to technical limits

8. Ads and sponsored content (now or in the future)

hyperPad does not currently display ads.

In the future, we may introduce limited advertising or sponsored content, including:

  • Ads within community areas of hyperPad
  • Ads in publicly shared projects

If we do:

  • We will not sell your personal data
  • Advertisers will not have access to your direct messages or account data
  • All ad activity will be governed by our Privacy Policy

9. Intellectual property

  • The hyperPad platform belongs to GamePress, Inc.
  • You may not copy, modify, or reverse-engineer it
  • You may not use our trademarks without permission

Your User Content remains yours.

10. Service changes and availability

hyperPad is constantly evolving.

We may:

  • Add, change, or remove features
  • Suspend the Services for maintenance
  • Discontinue parts of hyperPad

We do not guarantee uninterrupted availability.

11. Termination

You may stop using hyperPad at any time.

We may suspend or terminate access if:

  • These Terms are violated
  • Required by law
  • Continued use creates risk to hyperPad or others

Termination does not affect provisions that should reasonably survive.

12. Disclaimers

hyperPad is provided “as is” and “as available.”

We make no guarantees that:

  • hyperPad will always be available
  • Projects will generate revenue
  • The Services will meet every need

Use hyperPad at your own risk.

13. Limitation of liability

To the maximum extent permitted by law:

  • hyperPad is not liable for indirect, incidental, or consequential damages
  • Total liability is limited to the amount you paid us (if any) in the past 12 months, or US$100, whichever is greater

Some jurisdictions limit these exclusions; in those cases, limits apply as allowed.

14. Governing law and disputes

These Terms are governed by the laws of the province of Ontario, Canada, excluding conflict-of-law principles.

Disputes will be resolved exclusively in state or federal courts located in Ontario. You waive the right to a jury trial or class action, where permitted by law.

15. Final notes

  • These Terms, along with our Privacy Policy, form the entire agreement between you and us
  • If any part is held unenforceable, the rest remains in effect
  • We may assign these Terms in connection with a merger, acquisition, or reorganization
