hyperPad Software License Agreement

This Software License Agreement (“Agreement”) governs your use of hyperPad software and related services provided by GamePress, Inc. (“GamePress,” “hyperPad,” “we,” “us,” or “our”). By downloading, installing, or using any hyperPad software, you agree to this Agreement, our Terms of Use, and our Privacy Policy. If you do not agree, do not use the software.
1) The hyperPad apps (what this covers)
This Agreement applies to the following applications and services:
- hyperPad — The full creator app used to build, export, and distribute games and interactive projects.
- hyperPad Starter — A limited version of hyperPad intended as a trial and learning tool.
- hyperPad Hub — The standalone community-only app. Features include:
- Playing games
- Browsing and discovering projects
- Commenting, rating, messaging, and events
2) How these apps relate to each other
- hyperPad and hyperPad Starter include Hub features in-app
- hyperPad Hub is a standalone app offering the same community features without creation tools
- All Hub access shares one account system and one set of community rules
This Agreement governs software usage and licensing. Community behavior and accounts are governed by the Terms of Use.
3) Quick summary (plain English)
hyperPad (full version):
- Allows exporting and distributing Projects
- You own what you create
- May be used for personal, educational, and commercial projects
hyperPad Starter:
- Intended for personal evaluation and learning
- ❌ Not allowed for commercial use
- ❌ Not allowed for classroom or structured educational use
- ❌ Not intended for large-scale distribution
hyperPad Hub:
- Community-only app
- No creation, export, or monetization tools
- Free to use, subject to the Terms of Use
4) License grant
Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable license to:
- Install the software on devices you own or control
- Access Hub features where available
- Create Projects only in apps with creator functionality
This Agreement licenses the software, not ownership of it.
5) One user per license (creator apps)
For creator software (hyperPad and hyperPad Starter):
- The license is for a single individual user
- A primary and secondary device for the same user is allowed
- No sharing, concurrent use, or account pooling
The standalone hyperPad Hub app does not require a creator license.
6) hyperPad Starter restrictions (trial)
In addition to all general restrictions, you may not use hyperPad Starter:
- For any commercial purpose
- In classrooms, schools, camps, clubs, workshops, or other structured educational environments
- To generate revenue (ads, paid downloads, in-app purchases, sponsorships, client work, etc.)
- As a substitute for the full hyperPad license
Starter may have changing technical limits on export, sharing, and project count.
7) Projects and ownership
7.1 You own your Projects
You retain ownership of all Projects and content you create using hyperPad.
7.2 Your responsibility
You are responsible for:
- The content of your Projects
- Any third-party assets you include
- Compliance with app store rules and applicable laws
7.3 Community sharing
If you choose to share a Project publicly in the Hub, it becomes visible to other users under the Terms of Use.
8) Distribution and embedded device restriction
Normal app distribution. You may distribute Projects through app stores, subject to this Agreement and the applicable platform rules.
Embedded systems. You may not distribute or preinstall a Project on more than 1,000 devices if the Project provides the primary user interface or core functionality of that device, without a separate written license from us.
This does not restrict normal distribution of apps on phones, tablets, PCs, TVs, or set-top devices.
9) Gambling restriction
You may not publish or distribute Projects related to regulated gambling activities without a separate written agreement from us.
10) Privacy and connectivity
Use of all hyperPad apps is governed by our Privacy Policy.
The software may connect to our servers to:
- Enable Hub features
- Support cloud services (if enabled)
- Check for updates
- Provide analytics and crash reporting
We do not sell your personal data.
11) Termination
This Agreement remains in effect until terminated.
We may suspend or terminate your license if:
- You materially violate this Agreement
- Required by law
- Continued use would pose risk to hyperPad, other users, or our platform
Upon termination, you must stop using the software and delete copies you control.
12) Support and updates
Support, updates, and new features may be offered at our discretion. We do not guarantee continued availability of any feature.
13) No warranty
The software is provided “as is” and “as available.” We disclaim all warranties to the maximum extent permitted by law.
14) Limitation of liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, or consequential damages
- Total liability is limited to the greater of: the amount you paid us in the prior 12 months, or US$100
15) Indemnity
You agree to indemnify and hold harmless hyperPad from claims arising from:
- Your Projects
- Your use of the software
- Your violation of this Agreement or the law
16) Export compliance
You agree to comply with all applicable export and re-export laws.
17) Governing law
This Agreement is governed by the laws of Ontario, Canada, excluding conflict-of-law rules. Disputes will be resolved exclusively in Ontario.
