(“GamePress”, “hyperPad”) welcomes you to www.hyperPad.com (the “hyperPad”) and the content, functionality, and all other features of the hyperPad App (collectively, the “Site” or “Sites”). hyperPad is committed to protecting your privacy and developing technology that gives you the most powerful and safe online experience. This Privacy Policy applies to the our Site and describes how hyperPad collects and receives information about you through the Sites and through hyperPad’s businesses, including offline. The Privacy Policy together with the Terms of Use (https://hyperpad.webflow.io/terms-of-use) govern your use of the Sites and hyperPad’s’ collection and use of your information.

1. Acceptance of privacy policy

Each time you access, use, or browse any Site or provide personal information to HyperPad online or offline, you signify your acceptance of the then-current Privacy Policy and consent to the data practices described in this statement. If you do not accept this Privacy Policy, you are not authorized to provide information to HyperPad or use the Sites and must discontinue use of the Sites immediately.

Should the Privacy Policy be revised, HyperPad will post the changes on the Sites which will be effective immediately upon posting. Any material changes to the terms of the Privacy Policy will apply only to information collected thereafter, unless you provide consent. You can determine when the Privacy Policy was last revised by referring to the “Last Revised” legend at the top of this page.

HyperPad also may provide paper copies of the Privacy Policy when it collects information from you offline. In connection with your use of the Services, hyperPad may send you service announcements, administrative messages, and other information. You may opt out of some, but not all, of those communications.

2. Types of information we collect

We may collect personal information from you including, without limitation, non-public information about you that helps HyperPad identify you, such as your first and last name, birth date, email address, home address, telephone number, password, preferences and interests, income, education level, ethnicity, marital status, homeowner status, shopping habits, Site usage, age, gender, and other information that is not otherwise publicly available. We also may collect non-personal information about your use of the Sites such as your IP address, usage statistics, browsing history, type of computer operating system you use (e.g., Microsoft Windows™ or Mac OS™), the type of browser you use (e.g., Firefox™, Chrome™, Internet Explorer™, etc.), and the domain name of your Internet service provider. This information may be used by us for the operation of our business and the performance of our services, to maintain quality of our service, to provide general statistics regarding use of the Site, and as otherwise set forth herein.

Personal information collected by HyperPad may be stored and processed in the United States in accordance with the laws of the United States, or in other jurisdictions. By using the Sites and submitting your personal information to HyperPad online or offline, you expressly consent to the storage and processing of your personal information in the United States in accordance with the laws of the United States, or in other jurisdictions.

We may combine personal information we collect through our Sites or offline with information that we obtain from our affiliates, suppliers, vendors, merchants, licensors, or Activities partners or sponsors, and other sources (e.g., offline records or publicly available information). We will treat the combined information as personal information.

HyperPad may automatically receive and record non-personal information on our server logs from your browser as well as through other analysis of the Sites. We also may collect information using cookies, web beacons, or similar technologies, or through third parties using similar technologies. A cookie is a piece of data stored on your computer. When you visit the Sites, your web browser may store cookies on your computer, which will better enable you to navigate the Sites upon return. We use cookies to help you personalize your online experience. You have the ability to accept or decline cookies. You may use the Sites even if you choose to reject or delete the cookies. Cookies also may be used by some of the other websites for which a link is placed on the Sites. We may combine this non-personal information with personal information, and will treat the combined information as personal information.

You authorize HyperPad to transmit emails to you to respond to your communications and administer Activities. If you participate in Activities, you agree that HyperPad is authorized to contact prospective winners by telephone and send information, documents, and prizes to you by email or postal mail, as provided in the applicable rules. Unsubscribe instructions are included in each promotional email from HyperPad. Please note that such requests may take up to ten (10) days to become effective. You may not opt out of receiving communications regarding your dealings with HyperPad or the Sites or technical information about the Sites.

We shall not sell, transfer or lease out your personal data to third parties.

However, we may share your information in response to a subpoena, legal order, or official request, when we believe you have acted in violation of this Privacy Policy or the Terms of Use (https://hyperpad.webflow.io/terms-of-use), to investigate, prevent, or take action regarding suspected illegal activities, fraud, or potential threats, or exercise legal rights or defend against claims, when we believe that doing so may protect your safety or the safety of HyperPad or others, or as otherwise permitted or required by law. We also may use and share non-personally identifiable information with third parties. Additionally, we may take personally identifiable information and de-identify it and share it in a de-identified or aggregated form with advertisers, business partners, and/or third parties in order to analyze Sites usage, perform services on our Sites or others’ sites, improve our services, improve our user experience, or for similar purposes. We will not re-identify such data and we will ask our contracting parties to agree to keep the data in its de-identified form.

The online services are not directed toward children under 13 years of age nor does HyperPad knowingly collect information from children under age 13 on the online services. If you are under 13, you are not permitted to use the Sites or to register for emails or newsletters or to otherwise submit any personally identifiable information to HyperPad. If you provide information to HyperPad through the Sites, you represent that you are 13 years of age or older. If you are between 13 and 17 years of age, when you visit, browse, use, or submit personal information to the Sites, you represent that you have the permission of a parent or guardian to do so and who agrees to these Terms on your behalf. If you are a parent or guardian and believe HyperPad may have inadvertently collected personal information from your child, please notify HyperPad immediately by sending an email to contact@hyperpad.com detailing the basis of your belief and your request.

8. Protection of Personal Information

HyperPad uses reasonable administrative, physical, and electronic security measures to protect against the loss, misuse, and alteration of personal information. No transmission of data over the Internet is guaranteed to be completely secure. It may be possible for third parties not under the control of HyperPad to intercept or access transmissions or private communications unlawfully. While we strive to protect personal information, neither HyperPad nor our service providers can ensure or warrant the security of any information you transmit to us over the Internet. Any such transmission is at your own risk. If you directly disclose personally identifiable information or personally sensitive data through our public message boards, this information may be collected and used by others. When personal information (such as a credit card number) is transmitted by HyperPad to other Web sites, it is protected through the use of encryption, such as the Secure Socket Layer (SSL) protocol.

You are responsible for keeping your information current. You may update your information by contacting us at contact@hyperpad.com. We will use reasonable efforts to process any change you make; provided, however, that requests to delete information are subject to HyperPad’s internal reporting, processing, and retention policies and all applicable legal obligations.

You may have the opportunity to follow links on the Sites to other sites that may be of interest to you. HyperPad endeavors to link only to reputable organizations. Because other sites may not be hosted or controlled by HyperPad, we are not responsible for the privacy practices of those sites or the content provided thereon. Therefore, the privacy policies with respect to other sites may differ from those applicable to the Sites. We encourage you to review the privacy policies of each other site that you visit or plan to visit. This Privacy Policy only applies to information collected and maintained by HyperPad.

11. Notice of Privacy Rights TO California Residents

California law requires that we provide you with a summary of your privacy rights under the California Online Privacy Protection Act and the California Business and Professions Code. If you are a California resident and have provided personal information to HyperPad, you are entitled to request certain information regarding any disclosure that may have been made by HyperPad to third parties of personal information for their direct marketing purposes. In accordance with California law, we will provide you with the categories of personally identifiable information that we collect through the Site and the categories of third party persons or entities with whom such personally identifiable information may be shared for direct marketing purposes at your request. When contacting us, please indicate your name, address, email address, and what personal information you do not want us to share with third parties for their direct marketing purposes. Please note that there is no charge for controlling the sharing of your personal information or for processing this request.

Please allow thirty (30) days for a response. HyperPad is required to respond to only one request per customer each year, and is not required to respond to requests made by means other than through the above email address.
